Terms of Service

1. Acceptance of Terms

By accessing or using any service provided by GameHost ("the Company", "we", "us", or "our"), you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction), that you have read and understood these Terms of Service ("Terms"), and that you agree to be bound by them. If you do not agree to these Terms, do not use our services.

2. Services

GameHost provides game server hosting on a subscription basis. This includes:

  • Dedicated game server instances with the RAM allocation specified in your chosen plan
  • NVMe SSD storage as described in your plan
  • DDoS mitigation, daily automated backups, and a free subdomain
  • Access to our web-based control panel for server management
  • 24/7 technical support via ticket system and Discord

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of services.

3. Account Registration

You must provide accurate, complete, and current information when registering an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account, whether or not authorised by you
  • Notifying us immediately at [email protected] if you suspect unauthorized access

One account per person or organisation. You may not create accounts using false identities or for the purpose of abusing free-trial or promotional offers.

4. Payment & Billing

  • Billing cycle: Subscriptions are billed monthly in advance on your renewal date. Annual billing is available at a discounted rate.
  • Payment methods: We accept all major credit/debit cards and PayPal via our secure billing portal (powered by Stripe). All amounts are in USD unless otherwise stated.
  • Failed payments: If a payment fails, we will retry up to three times over 72 hours. After three failed attempts, your server will be suspended. Service is restored automatically once payment succeeds.
  • Suspension: Servers suspended for non-payment are retained for 7 days, after which they may be permanently deleted. We are not responsible for data loss resulting from payment failures.
  • Upgrades/Downgrades: You may change your plan at any time. Upgrades apply immediately with prorated billing. Downgrades take effect at the next renewal date.

5. Refund Policy

We offer a 30-day money-back guarantee on all new hosting plans. If you are not satisfied for any reason, contact us within 30 days of your first payment and we will issue a full refund — no questions asked.

The following are not eligible for refunds:

  • Renewals (the 30-day guarantee applies to first orders only)
  • Accounts suspended or terminated for Terms of Service violations
  • Add-on services purchased separately (e.g. additional IP addresses)
  • Requests made after the 30-day window has passed

Refund requests should be submitted via your client area or by emailing [email protected]. Approved refunds are processed within 5–10 business days depending on your payment method.

6. Acceptable Use Policy

You may not use our services for any of the following. Violations will result in immediate termination without refund:

  • Launching or facilitating DDoS attacks, port scanning, or network intrusion against any target
  • Hosting malware, ransomware, phishing pages, or any harmful software
  • Cryptocurrency mining of any kind
  • Distributing or storing child sexual abuse material (CSAM) — reported immediately to authorities
  • Spamming or sending unsolicited bulk email
  • Any activity that violates applicable local, national, or international law
  • Reselling our services without written authorisation
  • Running non-game-server workloads (e.g. web hosting, VPN services, bots unrelated to game servers) without prior written approval

We monitor for abuse at the network level only. We do not monitor the contents of your game server unless required to investigate an abuse report.

7. Service Availability & SLA

We guarantee 99.9% network uptime per calendar month, excluding:

  • Scheduled maintenance (announced at least 48 hours in advance)
  • Events beyond our reasonable control (force majeure, upstream provider outages)
  • Downtime caused by your server configuration, mods, or scripts
  • DDoS attacks that exceed our mitigation capacity

If we fail to meet the 99.9% SLA in a given month, you are eligible for a service credit of 5% of that month's fee for each hour of excess downtime, up to 50% of the monthly fee. Credits must be requested within 30 days of the incident and are applied to your next invoice.

8. Intellectual Property

The GameHost website, control panel, logos, and brand assets are the property of GameHost and are protected by applicable intellectual property laws. Game software, mods, and plugins you install remain the property of their respective owners — we claim no ownership over your server contents. You grant us a limited, non-exclusive license to store, process, and back up your data solely to provide the service.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the service is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, GameHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of revenue, or loss of goodwill — arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the total amount paid by you to us in the 3 months preceding the claim.

11. Termination

You may cancel your subscription at any time from your client area. Cancellation takes effect at the end of your current billing period.

We reserve the right to suspend or terminate your account immediately, without notice or refund, if you violate these Terms — particularly the Acceptable Use Policy. Upon termination for cause, we may permanently delete your server data without obligation to provide a copy.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or, where arbitration is not permitted, in the courts of competent jurisdiction. Nothing in these Terms limits your rights as a consumer under mandatory local consumer protection law.

13. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes via email or a notice in your client area at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes your acceptance of the revised Terms.
